Conflict, Claims and Construction Disputes: Adjudication Leading the Way

Delivered a presentation to a full house at the Malaysian Institute of Architects (PAM) Centre this morning on, ‘Conflict, Claims and Construction Disputes: Adjudication Leading the Way’.   Construction projects have a big influence on a nation’s economy and its society, with architects being key players. It is important to have an efficient, speedy and cost-efficient mechanism of resolving payment disputes that arise in this field.   This mechanism came in the form of CIPAA back in April 2014, which has gone on to become a big success.  As compared to arbitration and court litigation, Adjudication fast tracks construction and engineering contract disputes. CIPAA provides solutions specifically tailored to the particular situation of the Malaysia construction industries and accordingly provides protection for all professionals of the industry including architects. Also pointed out that KLRCA’s SFC amplifies the protection given to architects by essentially working towards the prevention payment related disputes from the onset and also provides for CIPAA compliant provisions. Not only does CIPAA promote the continuity of construction projects and a cost efficient dispute resolution, but it also ensures confidentiality, as the process is private.
