Presentation at the Society of Construction Law’s 7th International Conference which was attended by lawyers, Judges, Academicians, Engineers, Architects and other professionals from across the global construction field.

Discussed on, ‘Public Procurement and Global Development: The need for a refined dispute resolution mechanism’. South Asia has the highest share of public procurement in GDP at 19.3% and is now used as a policy tool to make markets competitive, reduce corruption and induce innovation. The sustainable development of public procurement includes the need for a refined system of not just dispute resolution, but also dispute management in various phases. Spoke on these 3 key phases, a comparison of the Malaysia and Indian framework, e-procurement, green public procurement, challenges faced, KLRCA’s Standard Form of Contracts as dispute avoidance, priority areas covering; risk allocation, continuity, current state of regulatory framework, prevention of spiralling templates, sector and region specific templates and accessibility and training. Also touched on the need to promote other forms of ADR (statutory adjudication, mediation etc) actively to create an ADR ecosystem and not just an arbitration ecosystem.
