In Hong Kong presenting at the conference on, ‘Dispute Resolution in Asia and Beyond: Progress and Trends’, organised by the City University of HK’s Centre for Chinese & Comparative Law (RCCL). Was part of a panel made up of Richard Kreindler, Paolo Marzolini & Ronald Sum. Shared my thoughts on the changing landscape of dispute resolution including its trends covering several areas such as; Internationalization of ADR or dispute resolution without borders, Pro-arbitration approach by legislature & judiciary, Redistribution of powers to order interim measures: emergency arbitrator, Reform of ISDS and its spill-over effect, The ADR’s expansion: new areas where ADR is gaining momentum, Focus on dispute avoidance in conventional sectors & Third-party funding. Concluded by summarising 3 key points. (1) The growth and success of ADR have resulted in innovations and the development of niche areas; energy & finance, life science, sports, environment & political disputes. (2) Although emerging sectors are looking at ADR, ‘conventional’ sectors are concentrating on dispute avoidance. (3) The landscape of dispute resolution is changing, however ADR is here to stay due to its adaptable and flexible nature. My slides can be found here https://lnkd.in/fjETxdA
